The Heights at Jackson Creek

The Heights at Jackson Creek has never been governed by a
Homeowners Association. When the developer created the covenants,
enforcement of them was transferred to the Design Review Committee,
not an HOA. (See Assignment of CCC&Rs) The Design Review
Committee ceased to exist within the next year or two.
In 2003, some homeowners organized a vote attempting to modify the
covenants and create an HOA with the power to collect dues ($89 per
year) and enforce covenants. The Design Review Committee was seen as
having weak authority, perhaps most notably, the inability to fine
people who did not comply with the covenants and the lack of any
source of funding. Classic Homes, Inc. contributed $10,000 in
funding to help the neighborhood fund the effort to draft amendments
to the covenants and organize a vote on the matter. The homeowners
involved hired an attorney to handle the election, create a
corporation and draft the modification of covenants. As part of this
past attempt, the Heights at Jackson Creek Community Organization
was filed with the Secretary of State.
The neighborhood voted and the attempt to modify the covenants
failed. The entity they created was administratively dissolved on
September 24, 2004.
